Public Offer

1. Definitions

• Service — the NutriFit online platform (website, backend, mobile applications, and related integrations) providing tools for fitness, nutrition tracking, health metrics management, and user interaction.
• User — any individual or legal entity using the Service.
• Account — the User's account in the Service.
• Content — any data, materials, and information posted by the User in the Service.

2. Subject of the agreement

The Company provides the User with access to the functionality of the Service, including tools for maintaining food and workout diaries, tracking health metrics, analytics, and other functions available within the selected plan.

The Service is provided on an "as is" and "as available" basis, without guarantees of continuity, fitness for particular purposes, or absence of errors.

3. Pricing, payment, and refunds

• Certain features of the Service are provided on a paid basis through a subscription. Current plans and terms are displayed in the Service or the relevant app store.
• Payment is made through third-party payment providers, including Stripe, Apple App Store, and Google Play. The Company does not store full payment credentials of Users.
• The subscription may be automatically renewed unless otherwise specified during checkout or canceled by the User before the end of the billing period.
• Subscription Cancellation: To cancel your subscription, follow the instructions for your platform: (a) Apple App Store — Open Settings > [Your Name] > Subscriptions > NutriFit > Cancel Subscription, or visit Apple Support; (b) Google Play — Open Google Play Store > Menu > Subscriptions > NutriFit > Cancel Subscription, or visit Google Support; (c) Web/Stripe — Contact us at office@nutrifit.company with subject "Cancel Subscription".
• Refunds are made in accordance with the rules of the payment provider or app store through which the purchase was made.
• Taxes, fees, and currency costs are applied in accordance with the rules of the relevant payment service.

4. Rights and obligations of the parties

The Company has the right to:

• modify the functionality, interface, and terms of use of the Service;
• suspend or terminate access in case of violation of the terms of the offer or law;
• remove or restrict access to Content that violates third-party rights;
• conduct technical work without prior notice.

The User undertakes to:

• provide accurate information upon registration;
• comply with applicable law and the terms of this offer;
• independently ensure the security of their account credentials.

5. Content and prohibited activities

The User is responsible for the posted Content and its legality. By posting Content, the User grants the Company a non-exclusive license to store and technically process it for the purposes of operating the Service.

It is prohibited to post illegal, harmful, offensive content, attempt to hack, bypass restrictions, or unauthorized data collection.

6. Liability and limitations

• The Service is not a medical product and does not replace consultation with a doctor or other qualified professional.
• The Company is not responsible for decisions made by the User based on information obtained in the Service.
• The Company's aggregate liability is limited to the amount actually paid by the User over the last 3 months or the equivalent of 100 USD — whichever is less.

7. Force majeure

The parties are released from liability for non-performance of obligations due to force majeure circumstances beyond reasonable control.

8. Suspension and termination

The Company has the right to suspend or terminate the User's access to the Service in case of violation of the terms of the offer or at the request of law.

9. Applicable law and disputes

This offer is governed by the laws of the State of Wyoming, USA. All disputes are subject to consideration in the courts of the specified jurisdiction.

10. Changes to the offer

The Company has the right to change the terms of this offer. The new version takes effect from the moment of publication in the Service.
